To the fullest extent permitted by applicable US federal and state law, JDM State Motors of NC LLC's total liability for any claim arising from the purchase, delivery, possession, installation, or use of any product sold through jdmmotorsnc.com shall not exceed the original purchase price paid by the buyer for that specific product. This limitation applies regardless of the legal theory under which the claim is brought, including contract, tort, strict liability, warranty, or negligence.
JDM State Motors of NC LLC shall not be liable for any consequential, incidental, indirect, special, or punitive damages — including but not limited to labor costs, towing fees, rental vehicle costs, lost wages, lost profits, or damage to other vehicle components — even if we have been advised of the possibility of such damages. Some US states do not allow the exclusion or limitation of incidental or consequential damages; in those states our liability is limited to the maximum extent permitted by law.
Shop labor, diagnostic fees, and installation costs incurred by the buyer are not covered or reimbursable under any circumstances.
Towing fees, rental vehicle costs, and transportation expenses related to a vehicle being inoperable are not reimbursable.
Lost wages, lost business profits, or any commercial income lost as a result of vehicle downtime are excluded from our liability.
Damage to other vehicle components, systems, or fluids caused by a part after installation is not within the scope of our liability.

If a dispute cannot be resolved through direct communication, both parties agree to attempt to resolve the dispute through good-faith negotiation for a period of not less than 30 days before either party pursues formal legal action. If negotiation fails, either party may pursue a claim in the state or federal courts of Wake County, North Carolina, as set out in Section 5 of this Legal Notice.
