Why This Disclaimer Exists

JDM State Motors of NC LLC operates jdmmotorsnc.com, an online retail store specializing in used Japanese domestic market (JDM) automotive engines, transmissions, suspension components, and related drivetrain parts. All products sold through our store are sourced directly from Japan and are used components that have been removed from vehicles previously operated on Japanese roads.

Because of the nature of our products — used mechanical parts with prior service history, imported from another country, intended for installation into vehicles built and registered in the United States — it is essential that every customer reads and understands this disclaimer before placing an order. This document explains the exact condition of our parts, what we warrant and what we do not, how compatibility works, what mileage disclosures mean, and what legal responsibilities you accept when purchasing from our store.

This disclaimer is part of our complete legal framework alongside our Terms of Service, Refund Policy, Privacy Policy, and Legal Notice. Together these documents govern every transaction made on jdmmotorsnc.com. If you have any questions before purchasing, please contact us through the form at the bottom of this page or call +1 (919) 803-0095 during business hours.

Key Facts About Every Product We Sell

  • All parts are used, pre-owned automotive components with prior service history unless the individual product listing explicitly states otherwise.
  • All parts are sourced directly from Japan and were originally manufactured for vehicles sold in the Japanese domestic market, which may differ from US-market vehicles in specifications, emissions output, and design.
  • JDM State Motors of NC does not manufacture, modify, or remanufacture any parts we sell. We act as a specialty retailer of used OEM components.
  • Parts are sold as-is unless a specific written warranty is explicitly stated within the individual product listing on jdmmotorsnc.com.
  • Parts are not tested, dyno-run, or leak-checked by our team unless the product listing specifically states that a part has been tested and includes the result.
  • We ship to US addresses only. All products must comply with applicable federal and state regulations in the state where they will be installed and used.

Used Parts Condition & Grading

Every engine, transmission, and mechanical component listed on jdmmotorsnc.com is a used part that was previously installed and operated in a vehicle. These parts are removed from Japanese vehicles and imported to the United States through established JDM import channels. They arrive in used condition. The following table explains exactly what buyers can expect based on our product categories.

Part Category Expected Condition External Wear Internal Assessment Buyer Action Required
JDM Engines (Complete) Used — pulled from running Japanese vehicle
Used Condition
Typical surface rust on external components, minor oil seepage normal for used engines, hoses and sensors may show age Internal condition reflects documented mileage; not torn down or inspected internally unless listing states otherwise Professional installation required; pre-installation inspection by a qualified mechanic recommended
Transmissions Used — removed from donor vehicle
Used Condition
Grime, surface corrosion, and seal weeping are common and expected Shift function not tested post-removal unless explicitly stated in listing Verify fluid condition and seal integrity before installation; professional inspection strongly advised
Suspension & Steering Used — condition varies by donor
Inspect Before Install
Bushings, boots, and ball joints may show wear consistent with mileage Strut inserts, spring rates, and alignment components not measured unless stated Inspect all rubber components for cracking; replace wear items as part of installation
Differentials & Transfer Cases Used — pulled complete
Used Condition
External oil seepage and surface corrosion expected Gear backlash and clutch pack condition not individually measured unless stated Drain and inspect fluid; replace seals as best practice before installation
Electrical & ECU Used — pulled with vehicle
Buyer Verifies Fit
Connector pins may show oxidation; harness condition varies ECU and electrical components are not bench-tested unless listing explicitly states Confirm exact part number compatibility before purchase; electrical refunds are limited per Refund Policy

What "Used" Means in the Context of JDM Parts

In the used automotive parts industry, "used" means the component was installed and functional in a vehicle prior to removal. It does not mean the part is damaged, failed, or non-functional. The vast majority of JDM engines and transmissions we sell came from low-mileage Japanese vehicles and are in serviceable, functional condition at the time of removal. However, because these are used mechanical parts, JDM State Motors of NC cannot guarantee that every part will operate indefinitely or perform identically to a new or remanufactured component. Buyers should treat every used JDM part as they would any quality used component — inspect it upon arrival, have it evaluated by a qualified mechanic, and address any wear items during the installation process.

Warranty Limitations & As-Is Disclosure

Unless a specific, written warranty is explicitly stated within the product listing for a particular item on jdmmotorsnc.com, all products are sold as-is. This means JDM State Motors of NC makes no express warranty and no implied warranty — including no implied warranty of merchantability and no implied warranty of fitness for a particular purpose — beyond what is explicitly stated in a specific product listing.

This as-is disclosure is consistent with the Uniform Commercial Code (UCC), which governs the sale of goods in the United States and permits sellers to disclaim implied warranties through a clear and conspicuous written statement. This disclaimer constitutes that statement for all transactions on jdmmotorsnc.com, and by completing a purchase you acknowledge having read it.

What We Do Warrant

Listing Accuracy

We warrant that product descriptions, mileage figures (where documented), and compatibility information listed in each product page on jdmmotorsnc.com are accurate to the best of our knowledge and based on available import documentation at the time of listing. If a listing contains a material error, please contact us immediately before installation.

What We Do Not Warrant

Post-Install Performance

We do not warrant that any part will perform to a specific standard after installation, that it will last a specific period of time, or that it will function identically to a new OEM component. Used parts have variable remaining service life based on their specific history, installation quality, operating conditions, and maintenance.

Warranty Voiding Conditions

Improper Installation

Any warranty explicitly stated in a product listing is immediately void if the part is installed by an unqualified individual without the proper tools, torque specifications, and procedures; if the part is modified after purchase; if it is used in an application for which it was not designed; or if it is damaged due to improper installation, oil starvation, overheating, or improper break-in procedures.

Labor & Consequential Costs

No Labor Coverage

JDM State Motors of NC is not responsible for any labor costs, towing costs, rental vehicle costs, lost wages, or any other consequential damages or incidental expenses that arise from the purchase, installation, use, failure, or return of any product purchased from our store. Our maximum liability is limited to the purchase price of the part itself.

Product Listing Warranties

Explicit Listings Only

If a product listing on jdmmotorsnc.com includes specific warranty language — such as a 30-day or 90-day warranty — that warranty applies only to the specific part listed and only under the conditions stated in that listing. It does not extend to any other parts you may have purchased simultaneously or to related components affected during installation.

Return Policy

How to Make a Claim

If you believe a part you received does not match its listing description, contact us within the window specified in our Refund Policy before any installation occurs. Once a part has been installed, our ability to evaluate its condition is significantly limited and return eligibility may be affected. Review our full Refund Policy for complete terms.

Vehicle Compatibility & Fitment Responsibility

JDM parts are originally manufactured for Japanese domestic market vehicles, which often share mechanical platforms with US-market vehicles but are not always identical in every specification. This is a fundamental characteristic of JDM parts purchasing, and it is the buyer's responsibility to confirm compatibility before placing an order.

Compatibility information provided in our product listings — including vehicle year, make, model, engine code, and trim level — is provided as a general guide based on manufacturer specifications and JDM import documentation. This information represents the vehicle from which the part was removed or the general application for which that engine or transmission is known to fit. It does not account for every regional variation, mid-cycle refresh, special edition trim, or optional equipment configuration that your specific vehicle may have.

Your Responsibility to Verify

  • Confirm the engine or transmission code matches your vehicle's factory spec sheet — not just the model name or year.
  • Confirm your vehicle's transmission type (automatic, manual, AWD, FWD) matches the unit being purchased.
  • Verify that any accessory drives, sensors, or mounting points will be compatible with your US-market vehicle and engine bay.
  • Consult a qualified mechanic who has experience with JDM engine swaps before placing your order if you are not certain.
  • Review the specific product listing carefully and contact us with any compatibility questions before purchase — not after.

Common JDM Compatibility Differences

  • JDM engines may produce different power output, compression ratios, or use different fuel octane requirements compared to their US-market counterparts.
  • Sensor connectors, O2 sensor ports, and emissions-related fittings may differ between JDM and USDM versions.
  • Transmission gear ratios on JDM units may differ from US-market gear ratios, affecting speedometer accuracy and final drive behavior.
  • Accessory brackets, power steering pump orientation, and A/C compressor mounts may not match US-spec vehicles directly.
  • Computer (ECU) programming may differ; JDM ECUs may require reprogramming, replacement, or use of a compatible US-spec ECU for full functionality.

Orders Placed for the Wrong Vehicle — Our Policy

JDM State Motors of NC is not responsible for the purchase of parts that are incompatible with your vehicle if the incompatibility results from the buyer's failure to verify fitment before ordering. Compatibility-related returns are subject to our Refund Policy and Cancellation Policy. If you have any doubt about compatibility, please contact us at jdmstatemotorsofnc@gmail.com or call +1 (919) 803-0095 before completing your purchase.

Mileage Disclosure & Documentation

One of the primary appeals of JDM parts is their typically low mileage compared to US-market used parts of the same age. Japan has strict vehicle inspection laws (the "Shaken" system) that incentivize vehicle owners to sell or scrap vehicles well before they accumulate the mileage common in the US. As a result, many JDM engines and transmissions are available with genuine low mileage figures that make them attractive replacements for high-mileage US-market vehicles.

However, JDM State Motors of NC is not the original owner of these vehicles and cannot independently verify every mileage figure provided through the import and auction documentation system used in Japan. The following disclosures apply to all mileage representations made on our product listings.

Documented Mileage

  • Where a product listing states a specific mileage figure — such as "60,000 km" — that figure is sourced from Japanese auction or dismantler documentation.
  • Japanese vehicles record mileage in kilometers (km). We display mileage in km and/or miles on our listings. 1 km = 0.621 miles.
  • Documented mileage reflects the odometer reading at the time of vehicle auction or disassembly in Japan, as recorded by the source facility.
  • JDM State Motors of NC passes this documentation through in good faith but cannot independently certify its accuracy beyond what the documentation states.

Undocumented Mileage

  • Some product listings may state "mileage unknown" or "undocumented." This means no verifiable mileage documentation was provided by the source in Japan.
  • In these cases, JDM State Motors of NC makes no representation about the actual mileage of the part and buyers should treat the part as a standard used component of unknown age.
  • Pricing for undocumented-mileage units reflects the uncertainty in their history. We do not inflate claims about undocumented units.
  • Undocumented mileage is disclosed clearly in each affected listing; if you have concerns, contact us before purchasing.

Federal Odometer Disclosure — 49 U.S.C. § 32701 et seq.

The Federal Odometer Act (49 U.S.C. § 32701 et seq.) prohibits odometer fraud in the sale of motor vehicles. JDM State Motors of NC sells individual automotive parts, not complete vehicles, and therefore the Federal Odometer Act does not apply to our parts transactions in the same way it applies to vehicle sales. However, we are committed to the spirit of this law — we do not misrepresent mileage, we disclose when mileage is undocumented, and we pass through all available documentation from the source facility in Japan. Any mileage figure we provide is given in good faith based on the documentation available to us.

OEM Brand & Trademark Disclaimer

JDM State Motors of NC LLC is an independent used automotive parts dealer. We are not an authorized dealer, affiliate, partner, or licensee of any original equipment manufacturer (OEM), automotive brand, or vehicle manufacturer. The brand names, vehicle model names, engine codes, and manufacturer names referenced on jdmmotorsnc.com are used solely for the purpose of accurately describing part compatibility and identifying the vehicles from which parts were removed.

What "OEM" Means for Our Products

When we refer to parts as "OEM" or "original equipment," we mean that the part was manufactured by or for the original vehicle manufacturer and installed in the vehicle at the factory — not that it is being sold by or through an authorized dealer network. Our parts are genuine factory components pulled from donor vehicles in Japan. They are authentic OEM parts in the sense of being original, unmodified manufacturer components — but they are sold through our independent dealership, not through an authorized manufacturer distribution channel.

Limitation of Liability

To the fullest extent permitted by applicable US federal and state law, JDM State Motors of NC LLC's total liability to any buyer for any claim arising from the purchase, delivery, possession, installation, or use of any product purchased through jdmmotorsnc.com shall not exceed the original purchase price paid by the buyer for that specific product.

JDM State Motors of NC LLC shall not be liable — under any theory of law including contract, tort, strict liability, negligence, or warranty — for any of the following categories of damages, even if we have been advised of the possibility of such damages.

01
Consequential Damages

Losses that result as a consequence of the failure of a part, including damage to other vehicle components, systems, or fluids caused by a failed or incompatible part after installation.

02
Incidental Damages

Out-of-pocket costs incurred in connection with a part purchase or failure, including diagnostic fees, towing costs, shop labor charges, rental vehicle fees, or storage fees.

03
Indirect Damages

Losses that do not flow directly from the part itself, such as business losses, lost contracts, missed appointments, or reputational harm resulting from vehicle downtime.

04
Lost Profits

Any commercial or personal income lost because a vehicle was out of service, a project was delayed, or a business use vehicle was unavailable as a result of a part purchase or installation issue.

05
Punitive Damages

Enhanced or exemplary damages of any kind. Our liability is strictly limited to the refund or replacement value of the specific part purchased, not to any punitive amount beyond that value.

State Law Notice — Some States Limit Liability Disclaimers

Some US states, including New Jersey, Massachusetts, and certain others, do not allow the exclusion or limitation of incidental or consequential damages in consumer contracts. If you are a resident of a state that imposes such restrictions, the limitations above may not apply to you in full. In those cases, our liability is limited to the maximum extent permitted by the law of your state. This does not affect any statutory consumer protection rights you may have under applicable state law.

Emissions, Legal Use & Regulatory Compliance

JDM engines, transmissions, and related drivetrain components are imported from Japan and were originally manufactured to comply with Japanese domestic emissions standards and vehicle regulations. Japanese emissions standards differ from those enforced in the United States by the Environmental Protection Agency (EPA) under the Clean Air Act and, in California, by the California Air Resources Board (CARB) under California Health & Safety Code Section 43000 et seq.

It is the sole responsibility of the buyer to determine whether a JDM part complies with the emissions and equipment regulations in the state where the vehicle will be registered and operated, and to obtain any required approvals or exemptions before installation. JDM State Motors of NC makes no representation that any part sold on jdmmotorsnc.com is compliant with US federal or any individual state's emissions regulations unless explicitly stated otherwise in the product listing.

Federal — EPA

EPA Clean Air Act

The US Clean Air Act (42 U.S.C. § 7401 et seq.) prohibits the installation of any engine or component that renders a motor vehicle non-compliant with federal emissions standards for vehicles registered on US public roads. Buyers are responsible for confirming that any JDM engine swap does not cause their vehicle to fail applicable federal emissions testing requirements.

California

CARB Regulations

California enforces the most stringent vehicle emissions standards in the US under CARB. Most JDM engine swaps are not CARB-compliant and cannot be legally installed in vehicles registered in California for street use without an EO (Executive Order) exemption. California buyers must verify CARB compliance independently before purchasing. JDM State Motors of NC cannot advise on CARB compliance for specific installations.

Other States

State Inspection Laws

Many US states conduct vehicle safety and emissions inspections. A JDM engine swap may cause a vehicle to fail a state inspection if the replacement engine does not match the original engine code on the vehicle's title or does not meet state emissions output requirements. Buyers in all states that conduct vehicle inspections should verify compatibility with state inspection procedures before purchase and installation.

Off-Road Use

Competition & Track Use

JDM engines and components are commonly used in competition, track-day, off-road, and race applications where on-road emissions regulations do not apply. For purely off-road or competition vehicles that will never be registered for public road use, emissions compliance is the responsibility of the buyer to verify under the rules of the relevant sanctioning body or event organizer.
